Constitution Court refers Justice Huegel to the ASUO Senate for a hearing, then withdraws the ruling

The ASUO Constitution Court voted unanimously to refer Justice Caleb Huegel to the ASUO Senate for a hearing, citing that Huegel’s unwillingness to participate in recent deliberations such as discussing Justice Allison Apana’s petition for review of Senator Bryan Vanderpool’s motion to remove her from office.

The Constitution Court voted that Huegel’s actions resulted in a nonfulfillment of duties; however, Chief Justice Nick Schultz is withdrawing his motion of referral of Huegel’s hearing on the grounds that the consequences of a nonfulfillment of duties need to be revamped first.

“The nonfulfillment protections currently in place are ineffective, unduly harsh and susceptible to abuse by students,” Schultz wrote in the press release. “I am committed to working with ASUO President Laura Hinman and ASUO Senate President Matthew Miyamoto on a comprehensive reform of the nonfulfillment of duties provisions of the ASUO Constitution.”

Schultz’s decision to work closer with Hinman and Miyamoto comes after the allegations of Huegel leaking confidential information to the public and Vanderpool’s motion to remove Apana from her seat.

Schultz and Justice Cedar Cosner deliberated on Monday night to discuss Apana’s petition of review of Vanderpool’s motion, but on Tuesday Vanderpool withdrew his motion to remove Apana. In his statement regarding his withdrawal, Vanderpool says that he is still concerned about the lack of checks and balances in certain parts of student government, but he hopes that stronger policies will help depoliticize the ASUO in the future.

“It has been upsetting to see the series of events that has played out over this past week as a result of the motion being made,” Vanderpool said.
